This FYI addresses the revised USERRA notice and other developments
that are effective January 18, 2006.
Revised Employer Notice: Employers generally are required
to provide employees entitled to Uniformed Services Employment
and Reemployment Rights Act ("USERRA") rights and benefits
with a notice of their rights, benefits, and obligations. An employer
may satisfy this notice requirement by posting the USERRA notice
where the employer customarily posts notices for employees; individual
notices are not required.
The government has issued two new notices to replace its prior
March 10, 2005 poster. One of the new posters is for private
sector and state government employers. The other new poster is
designed for Federal Executive Agency employers.

Other USERRA News: The Department of Labor also issued final
regulations regarding USERRA, including changes that affect health,
cafeteria, and retirement plans. The final regulations are
effective January 18, 2006. Plan administration and materials,
including COBRA materials, may need to be revised to address changes
made in these regulations.
